An OC confirms the building is legally fit for occupation. Without it, you face utility disconnection, loan refusal, and resale problems.

FAQ: What Is an Occupancy Certificate and Why Do I Need It?

An Occupancy Certificate (OC) is a document issued by the local municipal authority certifying that a building has been constructed in accordance with the approved plan and is fit for occupation. It is one of the most critical documents in a real estate transaction — and one of the most frequently overlooked.

The OC is issued only after the builder obtains a Completion Certificate (CC), which confirms that the construction is complete and structurally sound. The OC goes further: it confirms that the building complies with all building bylaws, has the necessary infrastructure (water, sewage, electricity, fire safety), and is safe for residents to occupy.

    Why you need an OC:

    1. Legal occupation: Occupying a building without an OC is technically illegal. Municipal authorities can issue notices and disconnect water and electricity supply to buildings lacking an OC.

    2. Home loan approval: Most banks and housing finance companies will not disburse the final loan installment or approve a loan for resale without a valid OC.

    3. Resale and registration: When you sell the property, the buyer's bank will demand the OC. Properties without an OC are difficult to sell and often fetch a lower price.

    4. Utility connections: Getting a permanent electricity connection, water connection, or property tax assessment requires an OC.

    5. Insurance: Building insurance claims may be rejected if the property lacks an OC.

The problem: many builders hand over possession without an OC, citing pending municipal approvals. This is a violation, and buyers should not accept possession in this state.

Our rule: never take possession without a valid OC. If the builder pressures you to take possession without it, that's a red flag. Insist on the OC as a condition of the final payment.
